JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Goraul P.S. Case No. 42 of 2017, registered under Sections 30(a)/32(ii)/38/41(i) of the Indian Penal Code. The accusation is of recovery of 2592 bottles, each containing 750 ML, of Indian made foreign liquor from the Pickup Van. Rajeev Kumar, driver of the Pickup Van, was apprehended, who disclosed the name petitioners and one Mahesh Paswan, having hand in keeping the liquor.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that petitioners were not apprehended at the spot rather their names have been disclosed by

Patna High Court Cr.Misc. No.62593 of 2017 (2) dt.21-12-2017 the driver of Pickup Van. Further submissions that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judgecum-Special Judge, Bihar Exercise Act, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 42 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
