The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2018. It is a case of recovery of country made liquor from the side of Charkki river.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the name of the petitioners came on the basis of local Chaukidars and they have no concern with the

No.29344 of 2022(2) dt.02-09-2022 2/2 seized liquor and nothing has been recovered from the conscious possession of the petitioners and they have not been apprehended at the spot. Petitioners have clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Ist Exclusive Special Excise Court, Bhojpur at Ara in connection with Chandi P.S. Case No. 43 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
