JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 22-12-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners being sister-in-law (Gotni) and the brothers of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that the sister of the informant, namely, Minti Devi was married to Rajesh Paswan about 10-11 years prior to the lodging of the case. The sister of the informant was tortured for non-fulfillment of further demand of dowry. On 19.10.2015 the informant learnt that his sister has been strangulated to death by the accused persons. No.62003 of 2017 (2) dt.22-12-2017 2/2 petitioners that the charge sheet was submitted under Sections 306 and 201/34 of the Indian Penal Code against the petitioners also and learned Magistrate vide order dated 04.11.2016 took cognizance under Sections 306 and 201/34 of the Indian Penal Code. Thrust of accusation is against the husband of the victim and petitioners are claimed to be separate from the husband of the victim.

Considering the fact that on conclusion of investigation charge sheet was submitted under Sections 306 and 201/34 of the IPC, cognizance has been taken under those sections and thrust of accusation is against the husband of the victim, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Barh in connection with Bhadaur P.S.
