JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 01-12-2020 Learned counsel for the petitioners undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioners and Mr. Binod Kumar, learned A.P.P. for the State.
Petitioners in the present case are seeking regular bail in connection with Nathnagar P.S. Case No. 75 of 2019 registered for the offence under Sections 304(B)/34 of the Indian Penal Code.
Earlier this Court had called for a report from the learned trial court. Now the learned trial court has submitted a report vide letter no. 60/Bhagalpur dated 13.11.2020 which is
Patna High Court CR. MISC. No.29213 of 2020(3) dt.01-12-2020 2/2 available at Flag 'A'. It appears that the trial is at fag-end and the matter is pending for final hearing. The court has also opened physically as well as virtually and, therefore, the learned trial court is willing to dispose of the case within one month if the defence and the prosecution both conclude their respective arguments as early as possible.
In the aforesaid view of the matter, this Court is not inclined to enlarge the petitioners on bail at this stage, however, the rejection shall not prejudice the case of the petitioners in the court below and the trial court is expected to conclude the proceeding and deliver judgment within one month from the date of receipt/production of a copy of this order. The prosecution as well as defence must co-operate and do not seek any adjournment in the matter when the case is taken up for final hearing within the aforesaid period.
Application stands disposed of.
