Petitioners seek regular bail in connection with Bettiah (Mufassil) P.S. Case No. 152 of 2021 registered for the offence under Sections 413 / 414 of the I.P.C. As per the First Information Report two persons riding on a motorcycle were intercepted by the Police and upon enquiry they disclosed their name as petitioners and said that the motorcycle in question was stolen one.
Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case by the Police with oblique motive and at the time of seizure the
Patna High Court CR. MISC. No.39359 of 2021(2) dt.21-01-2022 2/2 procedure under Section 100 Cr.P.C. has not been followed. He further submits that petitioners are in custody since 27/02/2021 having no criminal antecedent, charge sheet has already been submitted and trial is not likely to be concluded in near future. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioners are in custody since 27/02/2021, charge sheet has already been submitted and trial is not likely to be concluded in near future, I am inclined to grant regular bail to the petitioners.
Accordingly, let the petitioners, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Bettiah (Mufassil) P.S. Case No. 152 of 2021.
