Case No. 46 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation of recovery of 67.125 liters of illicit liquor from the house of the petitioner.
Submission of the learned counsel for the petitioner is that the whole allegation is false and he is an accused in one more case of similar type.
Heard learned A.P.P. also, who opposed the prayer for anticipatory bail on the ground of maintainability, as there is prima facie allegation against the petitioner. Having heard both sides, in view of the allegation and huge quantity of the liquor recovered from the house of the petitioner, I am not inclined to grant privilege of anticipatory
