JUSTICE JYOTI SARAN ORAL ORDER 05-08-2015 The complaint of the petitioner is that the Encroachment Case No. 2 of 2013-14 initiated by the Circle Officer, Brahampur in the district of Buxar for removal of encroachment from public land bearing Plot Nos. 3914, 3915 and 3916 in village-Mathiya, Post-Kaithi, P.S. Bagen Gola in the district of Buxar has not been taken to its logical conclusion. In support of his submission learned counsel refers to the order sheet of the encroachment case, a copy of which is placed at Annexure-5.

Having heard learned counsel for the parties and considering the nature of grievance raised, the writ petition is

Patna High Court CWJC No.11817 of 2015 (2) dt.05-08-2015 disposed of with a direction to the Circle Officer, Brahampur in the district of Buxar to consider and dispose of the Encroachment Case No. 2 of 2013-14 in accordance with law and after due service of notice as well as opportunity of hearing to the alleged encroachers to defend their respective cases. The proceedings be disposed of expeditiously and preferably within six months from the date of receipt / production of a copy of this order. (Jyoti Saran, J) S.Sb/- U
