This application, for grant of anticipatory bail, arises out of Munger Mahila Police Station Case No. 04 of 2018, disclosing offences under Sections 376, 417, 379/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Allegation against the petitioner is of committing rape on the informant on the pretext of marriage and thereafter, he married with the informant and also took Rs. 3 lac as dowry and is not ready to keep her.
Submission of learned counsel for the petitioner that out and out false and fabricated allegations has been leveled against the petitioner and the petitioner and informant were just
Patna High Court Cr.Misc. No.40955 of 2018 (2) dt.16-07-2018 2/2 only good friends and when the petitioner got appointment as constable in Bihar Police, the informant only with a view to put pressure on him has lodged this present false case. Having heard both sides, considering the facts and circumstances of the case as well as the nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner.
