JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-07-2018 The petitioner is apprehending his arrest in connection with Kateya P.S. Case No. 136/2018, registered for offences punishable under Sections 395 and 397 of the Indian Penal Code. Allegation against the petitioner and other is of committing loot on the petrol pump and of threatening the informant and others and also of firing.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and there is business rivalry between the informant and petitioner as both are contractors.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.42571 of 2018 (2) dt.23-07-2018 2/2 circumstances of the case and also the fact that petitioner is accused in three more cases, I am not inclined to grant him the privilege of anticipatory bail rather he should surrender before the court below and make prayer for regular bail, which will be decided on the merit of the case.

This application is accordingly dismissed.
