The petitioner seeks bail in anticipation of his arrest in connection with Madanpur P.S. Case No. 135 of 2018 dated 04.06.2018 instituted for the offences under Sections 341, 323, 332, 427, 506, 290, 291, 188, 283, 147, 148 and 149 of the Indian Penal Code.

While the civil authorities were trying to remove the encroachment, the accused persons created pandemonium and also hurled brick-bats.

Though the petitioner has been named in the F.I.R., but without any specific accusation. It has further been submitted that the Circle Officer who is the informant of this case does not know the petitioner and it appears that somebody having inimical terms with him

Patna High Court Cr.Misc. No.42176 of 2018(2) dt.20-07-2018 2/2 has supplied his name to be added in the column of the accused persons.

On the date of the occurrence, the petitioner was on his way to Gaya. In support of his contention, he has brought on record a photocopy of the electronic reservation slip.

Considering the nature of accusation against the petitioner and taking into account that the petitioner has no criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 135 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U T
