====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-12-2020 Heard learned counsel for the petitioner and the State through Video Conferencing.

Petitioner apprehends arrest in a case registered for the offence punishable under Sections 30 (a)/41/45 of the Bihar Prohibition and Excise Act, 2019.

As per the prosecution case, 270.36 liters of foreign liquor is alleged to have been recovered from Alto Car. It is further alleged that this petitioner along with other co-accused managed to flee away.

It is submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner and petitioner is neither the driver nor the owner of the vehicle in question. It is stated in paragraph no.3 of the bail

Patna High Court CR. MISC. No.29079 of 2020(2) dt.03-12-2020 2/2 petition that petitioner has got clean antecedent. Learned counsel for the State, on the other hand, opposes the prayer for bail.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned I/C Additional District Judge-II, Gopalganj in Manjhagardh Police Station Case No. 303 of 2019 vide G.R. No. 1386 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
