JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Simri P.S. Case No. 65 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.
As per F.I.R., allegation against the petitioners is that the petitioners along with other accused persons are of assault to the informant and brother-in-law of the informant, causing injuries.
Submission of the learned counsel for the petitioners is that there is a case and counter case between the parties and no
Patna High Court Cr.Misc. No.43903 of 2018 (2) dt.26-07-2018 2/2 specific allegation has been attributed against the petitioners. It has been further submitted that the petitioners have no criminal antecedent.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- IV, Buxar in connection with Simri P.S.Case No. 65 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
