JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-02-2021 The petitioner seeks bail in connection with Sessions Trial No. 533 of 2019 arising out of Kesariya P.S. Case No. 90 of 2019, dated 25.02.2019, instituted for the offences under Sections 341, 323, 307, 379 and 120(B) of the Indian Penal Code. Later on, Section 302 of the I.P.C. was added.

On 08.01.2021, this Court had called for a report about the stage of the case and had also asked for the

Patna High Court CR. MISC. No.29448 of 2020(3) dt.12-02-2021 2/2 photocopy of the case diary.

The report as well as the diary have been received.

The report indicates that five prosecution witnesses have been examined in this case and only the Investigating Officer is left to be examined. Considering the present stage of trial which is at its fag end, I am not inclined to grant bail to the petitioner. The prayer for grant of bail of the petitioner is, accordingly, rejected.

However, the Trial Court is directed to expedite and conclude the trial within a period of four months from the date of receipt/production of a copy of this order. The application stands disposed off accordingly. (Ashutosh Kumar, J) Praveen-II/- U T
