The petitioners apprehend their arrest in Morkahi (Amousi) P.S. Case No.127 of 2018 registered under Section 307 and other sections of the Indian Penal Code and under section 27 of the Arms Act.
The informant alleged that he purchased 3 kathas of land and constructed a hut thereon. Some lands are vacant. On
Patna High Court CR. MISC. No.29859 of 2019(2) dt.07-05-2019 2/3 04.10.2018 the petitioners came and started constructing pillar on the hut of the informant. When the informant and others protested, the petitioners are alleged to have assaulted the informant and his wife with fists and slaps. There is allegation that Panchu Sada fired but it did not hit anybody. Learned counsel for the petitioners submits that the present case was registered on 05.10.2018 and prior to institution of the case, the petitioner no.1 filed Complaint Case No.848C of 2018 against the informant and others in which the petitioner alleged that Sagar Sada and other accused persons entered into his house and assaulted the informant and his family members and took away different articles.
It appears that there is a dispute between the two sides with regard to the land. Having considered the facts aforesaid and the fact that there is a land dispute between the two sides, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Khagaria in connection with Morkahi (Amousi) P.S. Case No.
Patna High Court CR. MISC. No.29859 of 2019(2) dt.07-05-2019 3/3 conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
