The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that the petitioner opened fire at the husband of the informant, but the same did not hit him and thereafter the petitioner assaulted the informant and her husband.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.03.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Due to land dispute

Patna High Court CR. MISC. No.28572 of 2019(4) dt.27-08-2019 2/2 the present case has been instituted. All the offences are bailable except for offence under Section 27 of the Arms Act. General and omnibus allegation has been made.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-5, Kaimur at Bhabua in connection with Bhagwanpur P.S. case No.142 of 2018.
