The petitioners apprehend their arrest in Barun P.S. Case No.97 of 2018 registered under Sections 307, 395 and other minor Sections of the Indian Penal Code.

The informant alleged that he got information that one person was badly injured in motor accident. The informant and other police officials went there and found a person lying unconscious. The family members of the injured disclosed that Gautam Kumar knocked down by unknown vehicle. Thereafter strong mob assembled there and demanded to arrest the driver and pay the compensation. It is further alleged that the mob set ablaze the police station.

The learned counsel for the petitioners submits that 37

Patna High Court Cr.Misc. No.42451 of 2018 (2) dt.20-07-2018 persons were arrested and many other persons are alleged to have fled away. The petitioners are among them who managed to flee away. It is further submitted that similarly situated many other persons have been granted anticipatory bail. The accused persons, who were apprehended on the spot, have already been granted regular bail by this Court.

Taking into consideration the facts aforesaid and the nature of allegation made against the petitioners and the fact that many other persons who are named in the F.I.R. but not arrested on the spot such as Anil Kumar, Deepak Choudhary, Binod Paswan and others have been granted anticipatory bail, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No.97 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
