The petitioner is apprehending his arrest in connection with Pipra P.S.Case No.33 of 2019 , registered for offences punishable under Sections 341, 342, 323, 504, 354(B), 307/34 of the Indian Penal Code.

Prosecution case disclosed that the allegation against the petitioner and other accused persons is that they assaulted the informant and committed mar-pit in his shop for which Pipra P.S.Case No.25 of 2019 has been filed and for withdrawing the above case, the accused persons including the petitioner came variously armed and thrashed his sister on the ground and tried to disrobe her and the petitioner assaulted by Farsa on head. Submission of the learned counsel for the petitioner is that both are neighbour residing in the same house and the dispute is with respect to a statue of the father of the petitioner installed in front of the house, which the informant and others

Patna High Court CR. MISC. No.32525 of 2019(2) dt.17-05-2019 2/2 tried to remove. It has also been submitted that the injuries are simple in nature and the petitioner is ready to abide by any condition imposed upon him.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VI, Supaul in connection with Pipra P.S.Case No.33 of 2019, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
