JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-07-2023 The present writ petition has been filed seeking the following relief:- "1. For issuance of writ in the nature of Mandamus directing the respondent authorities to remove encroachment from the land in question i.e. Survey Plot No. 780,Tauzi No. 20, Pargana Phulwari in view of Letter No. 2461 dated 28-12-2022, issued under the Signature of Sub Divisional Officer, Danapur wherein he has clearly directed the Circle

Patna High Court CWJC No.7449 of 2023(2) dt.05-07-2023 2/2 Officer, Danapur to remove encroachment from the land in question after initiation of encroachment proceeding against the encroachers, as the ingress outgress of the petitioner and others have been obstructed due to said illegal encroachment." At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Danapur, District-Patna, for redressal of his aforesaid grievance. Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Danapur, District-Patna, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
