The petitioner is languishing in custody for the offence punishable under Sections 20 and 22 of the N.D.P.S. Act.
600 gms of ganja and other materials were seized from the house of the petitioner and co-accused Sushila Devi was arrested on the spot. Sushila Devi has already been allowed bail by a co-ordinate Bench of this Court. Petitioner has stated on oath that though the petitioner has share in that house, but the petitioner resides in a rented house at different place as the accommodation there is not sufficient. Petitioner was not there at the time of recovery. Petitioner has got no criminal antecedent. Petitioner is in custody since 27.02.2020.

No.29397 of 2020(4) dt.07-12-2020 2/2 Since there is no direct material of involvement of the petitioner in the act alleged, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Lahariasarai P.S. Case No. 94 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
