This is an application for grant of anticipatory bail in connection with Economic Office P.S. Case No. 39 of 2014 registered for the offence punishable under Sections 420, 406, 467, 468, 471 and 120B of the Indian Penal Code. The allegation against the petitioner is that he was Regional Manager of the non banking finance company and the informant had taken certain amount of bonds in the name of his sister and when he had approached the said company for refund he found that the said company was no longer at the place from where he had taken the bonds. It is further alleged that the petitioner being Regional Manager of the Company is the main culprit.
The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.61553 of 2017 (3) dt.11-01-2018 2/2 petitioner is an employee of the said Non Banking Company, hence, any liability may not be fastened on him. It is further submitted that in a case of similar nature arising out of the transaction pertaining to the same non banking company, the petitioner has been granted anticipatory bail by this Court on the ground that he is merely an employee and the main accused persons are the Directors, who have misappropriated huge sums of money.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the even of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Bhagalpur in connection with Economic Offence Case No. 39 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
