JUSTICE PRABHAT KUMAR JHA ORAL ORDER 29-04-2019 Heard Mr. Bimlesh Kumar Pandey, learned counsel for the petitioner and learned APP for the State. The petitioner apprehends his arrest in Srinagar Pujahan P.S. Case No.03 of 2019 registered under Sections 413, 414 and 34 of the Indian Penal Code and under Sections 3 and 4 of Bihar Preservation and Improvement of Animals Act. The police got secret information about illegal slaughter house running in the house of petitioner. When the police went to raid the house of the petitioner, some persons managed to flee away but one Jainuddin Khan was arrested. The police recovered the head and two legs of a calf from inside the courtyard of the house of the petitioner.
Learned counsel for the petitioner submits that Jainuddin Khan is own brother of the petitioner. The brother of
Patna High Court CR. MISC. No.27943 of 2019(2) dt.29-04-2019 2/2 petitioner has already been granted regular bail. The recovery was made from the joint house but it appears from the facts that both brothers were illegally running a slaughter house and his brother Jainuddin Khan was arrested on the spot and the petitioner managed to flee away.
Having considered the fact that the petitioner was illegally running a slaughter house and the head and two legs of a calf were recovered from inside the courtyard of the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.
