The petitioner apprehends his arrest in Alamnagar P.S. Case No.42 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant alleged that the petitioner threw a bag in maize field and fled away. On search, 30 litres of country made liquor found inside the bag thrown in the maize field. Learned counsel for the petitioner submits that on mere suspicion the name of petitioner was mentioned in the F.I.R. The petitioner has no manner of concern with the recovered bag containing liquor.

Having considered the fact that nothing has been recovered from possession of the petitioner, the above named petitioner, in the event of his arrest or surrender before the

No.28404 of 2019(2) dt.30-04-2019 2/2 learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II-cum-Special Judge, Excise Act, Madhepura in connection with Alamnagar P.S. Case No.42 of 2019 (Excise Case No.232 of 2019), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
