2. Learned counsel for the Bank has filed a counter affidavit stating therein that during the pendency of the writ petition the grievance of the petitioner has been redressed.

3. Learned counsel for the petitioner submits that he has no instruction from the petitioner in this regard.

Learned counsel for the Bank submits that as per Circular No. 22/2011 dated 29.12.2011, the case of the petitioner for consideration of promotion was considered and at the relevant time the departmental proceeding was pending against the petitioner so his result was kept under sealed cover. The said

Patna High Court CWJC No.8311 of 2012 dt.15-02-2024 2/2 departmental proceeding against the petitioner was concluded vide order dated 19.02.2014, thereafter the case of the petitioner was again considered by the Bank and he has accepted the same after furnishing a conditional consent dated 28.05.2014 and he has also joined the promotional post. It appears that the reliefs prayed for in the writ petition has been granted by the Bank and from bare perusal of the relief portion it appears that the petitioner is seeking quashing of Bani's HRD Circular No. 22/2011 dated 29.12.2011 issued by the Chairman of the respondent-Bank without making the Union of India and NABARD as necessary party in the writ petition.

5. In view of the aforesaid, it appears that the petitioner has been granted promotion and he has accepted the same after giving the consent letter dated 28.05.2014 to the Bank.

6. In view of the aforesaid, learned counsel for the petitioner seeks permission to withdraw the writ petition.

7. This application is accordingly dismissed as withdrawn.
