====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 08-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, who is in custody since 19.12.2020 seeks bail in connection with Spl. Case No. 194 of 2020, arising out of Salimpur P.S. Case No. 308 of 2020, registered for the offence punishable under Sections 341, 323, 504, 506 and 354(B) of the Indian Penal Code, Section 8 of POCSO Act and Section 3(1),(r), (w), 3(2)(va) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, pending in the Court of learned Addl. Sessions Judge-VI-cum-Spl. Judge, POCSO, Patna.

Taking into consideration the nature of allegation made against the petitioner as well as progress, which has taken place in the trial. There are altogether six prosecution witnesses

Patna High Court CR. MISC. No.41409 of 2021(4) dt.08-03-2022 2/2 out of them three prosecution witnesses have already been examined, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the prayer for grant of regular bail is rejected.

However, the learned trial Court is directed to conclude the trial expeditiously, well within a period of four months. If no substantial progress takes place in trial, the petitioner, if so advised, may renew his prayer for bail after four month.
