The petitioner seeks anticipatory bail in connection with Agiaon (Garahani) P.S. Case No.51 of 2018, registered for offences punishable under Sections 323, 341, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R., allegation against the petitioner is that the petitioner started indiscriminate firing in a Barat and caused injury in the left hand of the informant.

Submission of the learned counsel for the petitioner is that there is a delay in sending the copy of the FIR to the Court of learned Chief Judicial Magistrate and further no specific allegation has been attributed against the petitioner and there is no vital injury found on the person of the informant. Learned A.P.P. opposes the prayer for bail.

No.44139 of 2018(2) dt.27-07-2018 2/2 Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Agiaon (Garahani) P.S. Case No.51 of 2018, to the satisfaction of learned Additional Chief Judicial Magistrate, Bhojpur (Ara), subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
