JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2018 The petitioners are apprehending their arrest in connection with Jaynagar P.S. Case No. 18 of 2018, registered for offences punishable under Sections 188, 379, 411, 353, 323, 504, 34 of the Indian Penal Code and Section 21 of the Mines and Mineral Development and Rule 40 of Bihar Minor Mines and Mineral Concession Rule 1972.

Allegation as per F.I.R. is that police intercepted the tractor of the petitioners who are drivers and in the meantime one Vinod Singh and 25 other persons started scuffling with the police personnel and taking advantage of the situation, petitioners fled away from the place of occurrence.

It has been submitted on behalf of the petitioners that the

Patna High Court Cr.Misc. No.42485 of 2018 (2) dt.24-07-2018 2/2 allegation is against one Vinod Singh and not against the petitioner.

Heard learned A.P.P. also who opposed the bail application.

Having heard both sides and in view of the above facts and circumstances of this case, I am not inclined to grant privilege of anticipatory bail to the petitioners rather they should surrender before the court below and make prayer for regular bail which would be considered on the merit of the case. Accordingly, this application is dismissed.
