JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Udakishunganj P.S. Case No. 358 of 2019 for the offences under Sections 341, 323, 324, 504, 354 and 302/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner is a lady and she has no criminal antecedent.

Learned counsel appearing on behalf of the petitioner submits that there is allegation of assault with saucepan on the head of the informant against the petitioner but no corresponding injury was found on the head of the informant.

No.25423 of 2020(2) dt.29-09-2020 2/2 Considering the fact that the petitioner is a lady and she has no criminal antecedent and she has remained in custody for nearly six months, the Court is inclined to grant bail to her. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Uda-Kishunganj, District Madhepura in connection with Udakishunganj P.S. Case No. 358 of 2019, subject to the conditions:- (i) Bailors should be family members of the petitioner;

(ii) The petitioner shall extend full cooperation in early conclusion of the trial; and (iii) In the event the petitioner is found in influencing the witnesses, the court below shall be at liberty to cancel bail bonds.
