A counter affidavit has been filed by Mr. Trivedi wherein the order passed by the Director, Consolidation on 04.07.2011 (Annexure-B) has been enclosed. The order passed by the Presiding Officer of the Bihar Hindu Religious Trust Tribunal in case no. 11 of 2009 under Section 43 is also enclosed therewith.
Patna High Court CWJC No.3846 of 2013 (4) dt.20-01-2016 2/2 Mr. Kumar states that the petitioner was not aware of the order of the Director, Consolidation before the same was not made part of the record of this case by way of counter affidavit.
Having appreciated the stand taken by the respondent, he sought permission of the Court to withdraw this writ application so that he may take recourse to the law and challenge the order of the Director, Consolidation. In view of the aforesaid, the application, as prayed, is permitted to be withdrawn.
