JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-08-2023 The present writ has been filed seeking the following reliefs:- "1(i). To issue a writ of mandamus commanding and directing the Respondents herein particularly the Respondent No. 2 I.e. the Secretary of the Road Construction Department, Government of Bihar, Patna to open the 'sealed cover' carrying the recommendations of the Departmental Promotion Committee as made in its meeting held on 01.08.2014 (Annexure-1), qua this petitioner, as no departmental or criminal proceeding is/was pending against this petitioner either on 01.08.2014 or afterwards which relates to this petitioner's promotion from the post of Junior Engineer to Assistant Engineer;

Patna High Court CWJC No.11116 of 2015(2) dt.24-08-2023 2/2 (ii) To direct the respondents to act on the recommendations of the DPC after opening of the 'sealed cover' and in the event of a favourable recommendations, place the petitioner by issuing appropriate orders promoting this petitioner from the post of Junior Engineer to the cadre and post of Assistant Engineer (Civil List) under Bihar Engineer Service Cadre-II in the revised Pay Band II with Grade Pay of Rs. 5400/- from the due date with payment of arrears thereof along with consequential benefits;."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent authorities for redressal of his subsisting grievances, if any. Liberty, so sought, is granted.
