2. The present application has been filed for cancellation of regular bail granted by a co-ordinate Bench of this Court vide order dated 11.08.2023 passed in Cr. Misc. No. 51605 of 2023 arising out of Chiraiya P.S. Case No. 218 of 2022.
3. Learned counsel for the petitioner submits that Court, while granting bail, has noted that only simple injury was caused to the victim whereas grievous injury has also been caused to the victim and therefore the prayer of the petitioner may be allowed.
4. Learned counsel for the opposite party no. 02 has
Patna High Court CR. MISC. No.36687 of 2024(8) dt.16-07-2026 2/2 submitted that the injury report was annexed with the bail application and there is no suppression of facts from the side of opposite party no. 02. He also submits that the trial has started and witnesses are being examined and there is no allegation against the opposite party no. 02 of tampering with the evidence or of threatening the witnesses.
5. In view of the above, this Court is not inclined to cancel the bail granted to the opposite party no. 02.
6. Accordingly, this application is dismissed.
7. However, the opposite party no. 02 is directed to co-operate in the trial.
