====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 18-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Chautarwa P.S. Case No.163 of 2016 registered under Sections 304(B) and 201/34 of the Indian Penal Code.

The accusation is that the deceased, the daughter of the informant, was being tortured for non fulfillment of motorcycle in dowry by her husband and other in-laws and due to non fulfillment of the dowry demand, she was killed by them and her dead body was disposed of.

Learned counsel for the petitioners submits that the

Patna High Court Cr.Misc. No.57705 of 2017 (2) dt.18-12-2017 2/2 petitioner no.1 is brother and the petitioner no.2 is maternal grandmother (Nani) of the husband of the deceased, the daughter of the informant, and they have falsely been implicated in this case. Further submission is that, on investigation, the police submitted the chargesheet against Anurag Sah, the husband of the deceased, the daughter of the informant, who after having faced the trial has been acquitted by the court of the 1st Additional Sessions Judge, Bagaha, District-West Champaran, vide Judgment dated 29.08.2017 passed in Sessions Trial No.279 of 2017, which would appear from Annexure-2 to this application.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagha, West Champaran, in connection with Chautarwa P.S. Case No.163 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
