The petitioners apprehend their arrest in a case registered for the offence under Sections 363, 366(A)/34 of the Indian Penal Code.

As per F.I.R., co-accused Mritunjay Kumar kidnapped the minor daughter of the informant for the purpose of marriage. It is further alleged that these petitioners assisted co-accused Mritunjay Kumar in committing the offence.

It is submitted on behalf of petitioners that as per F.I.R. itself, specific accusation is against Mritunjay Kumar and petitioners have been made accused only because they are

Patna High Court CR. MISC. No.30025 of 2022(2) dt.29-09-2022 2/2 family members of co-accused Mritunjay Kumar. Petitioner no. 1 is married sister, petitioner no. 2 is mother and petitioner no. 3 is elder brother of co-accused Mritunjay Kumar. Petitioners have no criminal antecedent.

Considering the same, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Darauli P.S. Case No. 269 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
