JUSTICE SATYAVRAT VERMA ORAL ORDER 21-07-2022 Heard learned counsel for the petitioner, learned counsel for the NBPDCL and learned APP for the State. The learned counsel for the power company at the outset submits that case has been investigated, charge-sheet has been submitted, the case has been found true and cognizance has been taken under Sections 135 and 138 of the Electricity Act.

The learned counsel thus submits that the present quashing application was filed seeking quashing of the F.I.R., now the stage has changed and the order taking cognizance is not under the challenge, as such, for the present, the quashing

The learned counsel for the petitioner, in view of the submission made by the learned counsel for the Power Company, seeks permission to withdraw the present quashing application.

Permission is accorded with a liberty to the petitioner to challenge the order taking cognizance.

Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
