Petitioner apprehends arrest in a case registered for the offence punishable under Sections 272/273 of the Indian Penal Code and sections 30/38/41 of the Bihar Prohibition and Excise Act.

Total 138 liters of foreign liquor has been recovered from a Maruti car and one Deepak Kumar was apprehended who disclosed the name of the petitioner and other accused persons as his associates who managed to flee away at the time of making raid.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. He is neither owner nor the driver of the vehicle. Petitioner has got no criminal antecedent.
