2. The petitioner apprehends his arrest in connection with Laheriasarai P.S. Case No. 473 of 2023 registered under Sections 341, 323, 448, 379, 308, 504, 506 and 34 of the Indian Penal Code.
3. As per prosecution case, the specific allegation against this petitioner is that he gave iron rod blow on the head of the informant due to which he sustained injury.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that due to petty dispute altercation took place between the parties. Case and counter case. The case of the petitioner was prior to the
Patna High Court CR. MISC. No.32772 of 2024(2) dt.22-05-2024 2/2 present case. It is also submits that the First Information Report has been lodged after a delay of 10 days without any plausible reason. The petitioner has got no criminal antecedent.
5. Having considered the delay in filing the present case coupled with the fact that petitioner claims clean antecedent, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 473 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
