"That the present writ application is for issuance of an appropriate writ in the nature of mandamus directing and commanding the respondents concern to appoint the petitioners as Assistant Teacher in the Primary School in the light of Final Merit List as prepared by the Respondent Commission (Respondent No.4) for appointment of Teachers Bihar Special Primary Teachers Appointment Rule 2010 in the light of M.J.C. No.297 of 2007 arises out of S.L.P. (Civil) 22882 of 2004 for one time appointment of Primary Teachers as well as in the light of order dated 18.07 2013 and order dated 15.01.2014 passed by Hon'ble Mr. Justice Mihar Kumar in C.W.J.C. No. 17899 of 2012 (Kanti Kumari Vs. The State of Bihar & others) besides the other relief/ reliefs for which they are entitled under the law."

At the outset, learned counsel for the petitioner seeks permission to withdraw this application with liberty to file appropriate representation before the authority concerned for the grievances raised by the petitioners in the instant application. Without entering into the merits of the case of the respective petitioners, the writ application is disposed of as

In case the representation is filed by the petitioners before the Director, Primary Education, Government of Bihar, Patna, respondent no.3, the same shall be decided in accordance with law within a period of four months from the date of its receipt.

This application stands disposed of with the aforesaid liberty.
