JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Dariyapur P.S. Case no. 164 of 2017, registered under Sections 302 and 201/34 of the Indian Penal Code.
The accusation is of killing of the sister of the informant, whose marriage was performed before 10 years with Arbind Kumar Rai, due to non-fulfillment of demand of cash of Rs. 25,000/- and motorcycle in dowry and to dispose of her dead body. Learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased sister of the informant. Further submission is that both the petitioners used to reside separate to Arbind Kumar Rai, husband of the deceased, but with ulterior motive, they have falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran in connection with Dariyapur P.S. Case No. 164 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
