The petitioners seek anticipatory bail in connection with Bahadurganj P.S. Case No.85 of 2018, registered for offences punishable under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioners is that the petitioners and other persons came to the house of the informant and petitioner no.1 assaulted the informant by knife and allegation against petitioner no.2 is general and omnibus. Submission of the learned counsel for the petitioners is that the injuries are simple in nature and FIR itself shows that there is a land dispute between the parties. It is further submitted that the petitioners have no criminal antecedent. Learned A.P.P. opposes the prayer for bail.

No.44246 of 2018(2) dt.27-07-2018 2/2 Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Bahadurganj P.S. Case No.85 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
