The petitioner apprehends his arrest in Shyampur Bhatha P.S. Case No.23/2018 registered under Section 420, 467, 468, 471, 506/34 of the Indian Penal Code.

The informant alleged that he owns a piece of land by the side of Community Hall situated in the village but Suresh Singh fraudulently got the sale deed executed in his favour by impersonating him.

Learned counsel for the petitioner submits that admittedly Vikash Kumar Verma and Aditya Kumar Verma executed the sale deed in favour of Suresh Singh with regard to the land. The petitioner has identified the executor of the sale deed. There is no case of impersonation of the informant. The vender claimed that the land belonged to them and accordingly

Patna High Court Cr.Misc. No.42472 of 2018 (2) dt.20-07-2018 2/2 they executed sale deed. It is further submitted that other accused namely Raj Mangal Singh has already been granted anticipatory bail vide order dated 29.06.2018 passed in Cr. Misc. No.36796 of 2018.

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sheohar, in connection with Shyampur Bhatha P.S. Case No.23/2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
