The petitioner is apprehending his arrest in connection with Singhwara P.S.Case No.194 of 2018 registered for offences punishable under Sections 363, 366/34 of the Indian Penal Code.

Allegation against the petitioner and other co-accused persons is of enticing the minor daughter of the informant away. Submission of the learned counsel for the petitioner is that the allegation is false and concocted and she has now been recovered also.

On the other hand the learned A.P.P. has opposed the prayer for bail on the ground that in her statement recorded under Seciton 164 of Cr.P.C. she has named this petitioner and also accepted that he tried to do some forceful act with her and

Patna High Court CR. MISC. No.35053 of 2019(5) dt.05-09-2019 2/2 the Medical Board assessed her age between 17 - 18 years. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day. With the aforesaid direction, this application is dismissed.
