Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Balua Bazar P.S. Case No. 32 of 2018, registered for the offences punishable under Sections 457, 380 of the Indian Penal Code. The informant alleged that on 15.05.2018 in the night, theft was committed in his house by some unknown miscreants. Submission of petitioner is that petitioner is not named in the FIR. Name of this petitioner has come in this case on the basis of confessional statement of co-accused Ashok Kumar Verma. Petitioner is innocent and has committed no

Patna High Court CR. MISC. No.29341 of 2020(2) dt.09-12-2020 2/2 offence. No incriminating article has been recovered from possession of this petitioner. Other co-accused has been granted anticipatory bail by a coordinate Bench of this court vide order dated 25.10.2018 passed in Cr. Misc. No. 54678 of 2018 (Annexure-2). Petitioner has got clean antecedent, as stated in para 3 of the petition.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Supaul in connection with Balua Bazar P.S. Case No. 32 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
