====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-11-2020 Heard Mr. Bhola Prasad, learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Sessions Trial No. 92 of 2019, arising out of Shahpur P. S. Case No. 138 of 2018, instituted for the offences under Sections 302, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

On 01.10.2020, a report had been called for about the stage of the case from the court below which report has since been received.

It appears that so far, six witnesses have been examined and there is every likelihood of the trial being

Patna High Court CR. MISC. No.25280 of 2020(3) dt.09-11-2020 2/2 concluded in near future.

Regard being had to the nature of accusation and the stage of trial, I am not inclined to grant bail to the petitioner for the present.

However, if the trial is not concluded within a period of six months from the date of production/receipt of a copy of this order, the petitioner would be at liberty to approach the trial court and seek bail.
