JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Madhepura P.S. Case No. 359 of 2017, registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code. The accusation is that petitioners in collusion with one another executed the three sale deeds vide sale deed nos. 8072 dated 21.09.2016, 9588 dated 25.11.2016 and 9986 dated 22.12.2016 in the name of petitioner nos. 1 and 2, Anmol Yadav and Naresh Yadav by submitting forged documents, while petitioner nos. 3 and 4 have put their signatures on the sale deeds. Learned counsel for the petitioners submits that, in

Patna High Court Cr.Misc. No.56935 of 2017 (2) dt.08-12-2017 fact, informant executed the sale deeds in favour of petitioner nos. 1 and 2, in which, petitioner nos. 3 and 4 have put their signatures as witness, but with ulterior motive the present case has been lodged with false allegation. Further submission is that the dispute as disclosed in the F.I.R. is of civil in nature. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S. Case No. 359 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
