Petitioners apprehend their arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition Excise Amendment Act, 2018.

Prosecution case is that 41.250 liters of foreign liquor was recovered from car.

Learned counsel appearing for the petitioners submits that recovery has been made from the vehicle. Petitioner is not the owner nor the driver of the said vehicle. Nothing has been recovered from the conscious possession of the petitioners. Petitioners have got no criminal antecedent.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. 01, Aurangabad in connection with Madanpur Police Station Case No. 176 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
