The petitioner is languishing in custody for the offences punishable under Sections 420/406/467/468/471 of the Indian Penal Code.

Allegation against the petitioner is that he cheated to the informant by creating a forged bank account. Cheating was made allegedly by inducing the informant to get qualified in IAS exam.

Learned counsel for the petitioner submits that the case-diary would reveal that neither the bank account was of the petitioner nor the petitioner had issued any refund cheque which allegedly bounced. Investigation of the case is already complete

Patna High Court CR. MISC. No.25379 of 2020(3) dt.05-01-2021 2/2 and petitioner has got no criminal antecedent. Considering the submission aforesaid, let the petitioner, above named, who is in custody since 09.03.2020, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gopalganj P.S. Case No.160 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
