JUSTICE SHIVAJI PANDEY ORAL ORDER 28-09-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking regular bail in connection with Hajipur Sadar P.S. Case No. 366 of 2019 registered for offence punishable under section 382 IPC and later on, section 392 IPC has been added.

The petitioner has earlier moved before this Court in Cr. Misc. No. 349 of 2020 and this Court, vide order dated 19.03.2020 rejected the same with the liberty to the petitioner to renew his prayer for bail after nine months of his judicial custody.

Looking to the observation and the petitioner has remained in judicial custody more than required period, the petitioner, above named, is directed to be released on regular

Patna High Court CR. MISC. No.25269 of 2020(2) dt.28-09-2020 2/2 bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 366 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. The petitioner will report to the Hajipur Sadar Police Station by 7th of every month for at least six months.
