2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 310 ( 4 ), 310 (5) of BNS and 25 (1-b)/a/26/35 of Arms Act.

3 . As per the prosecution case , on secret information that some miscreants have assembled to commit crime and a raid was conducted in the semi constructed house of petitioner where three other co-accused persons were arrested on the spot. It is further alleged that 0.315 rifle were recovered from the possession of accused Mithun Kumar, one Desi Katta was recovered from possession of one Sunny Kumar and one live catridge from Mohan Kumar.

4. It is submitted on behalf of the petitioners that petitioner is quite innocent and has falsely been implicated in this case . No incriminating articles have been recovered from the semi constructed house of this petitioner and he has got no concern with the alleged occurrence . The alleged recovery has been made from the possession of other co-accused persons. Petitioner has got one criminal antecedent of similar nature . 5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge - IV- cum ACJM IV Begusarai in connection with Sahebpur Kamal P.S. Case No. 387 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
