Petitioner apprehends his arrest in connection with Kankarbagh P.S. Case No.900 of 2022, registered for the offence punishable u/s 379/120(B)/34 of the IPC. 3.

As per the prosecution case, four accused persons in connivance with one Ranjit Kumar took away cassettes with amount of Rs.25,00,200/- from the ATM.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He is not named in the F.I.R. and has been falsely implicated in this case. He has been made accused in this case on the basis of confessional statement of the co-accused Priyanka Kumari and

Patna High Court CR. MISC. No.35656 of 2023(3) dt.28-08-2023 2/2 on her statement, police has recovered money and other articles from her house along with that two cars were also recovered. No incriminating article has been recovered from the conscious physical possession of the petitioner. Petitioner has two criminal antecedent.

Learned APP for the State opposed the prayer for bail by submitting that petitioner is a member of the syndicate involved in the alleged occurrence.

Having regard to the facts and circumstances of the case and considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

This application is accordingly dismissed.
