The issue involved in the present writ application is whether the certificate of graduation of the petitioner is genuine or fake.

Mr. Dhananjay Kumar, learned counsel appearing on behalf of the petitioner would submits that graduation certificate of the petitioner is genuine and without any verification, the respondents have cancelled

Patna High Court CWJC No.12397 of 2015(2) dt.26-03-2021 2/3 the candidature of the petitioner and favoured respondent No. 5 in the process of appointment as Anganbari Sevika.

Considering the aforesaid contention of the petitioner, the writ application is disposed off with a direction to the District Education Officer (D.E.O), Patna/respondent No. 3 to send a special massanger to the Magadh University, Bodh Gaya within a period of 15 days from today for verification of the genuineness of the certificate. If the certificate of graduation of the petitioner is found to be genuine, the petitioner shall be re-considered for appointment as Anganbari Sevika. In the event the certificate of the petitioner is found to be fake, the District Education Officer, Patna shall be under an obligation to lodge criminal case against the petitioner for using such fake document for the purpose of appointment. Necessary decision in this regard must be taken by the respondents within a maximum period of 60 days from today after hearing all concerned.
