JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-07-2019 This application, for grant of anticipatory bail, arises out of Buniyadganj P.S. Case No. 187 of 2017, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act.
Prosecution case is that police on secret information that petitioner and one Madho Paswan is doing illegal business of liquor raided the village and after seeing the police, two persons started fleeing away and police chased them but they succeeded in fleeing away and, thereafter, police recovered 6 litres of mahua liquor and also the apparatus for preparation of liquor.
Submission of learned counsel for the petitioner is that there is no recovery either from his possession or from his house and he has been made accused in this case only on the
Patna High Court CR. MISC. No.28106 of 2019(3) dt.15-07-2019 2/2 basis of suspicion and there is no source of identification. Heard learned A.P.P. also.
Having heard both sides, considering the fact that there is no recovery either from the possession or from the house of the petitioner, as such, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Buniyadganj P.S. Case No. 187 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
